HempLucid prioritizes adherence to the highest standards of compliance so that our customers always know they can trust our company and our products. Because of that, we maintain strict compliance with California Proposition 65 (Prop 65) regulations.

WHAT IS PROPOSITION 65?

California’s Proposition 65 (Safe Water and Toxic Enforcement Act) was approved in 1986 and requires the State to publish a list of chemicals known to the state to cause cancer, birth defects, or reproductive harms. The published list has grown to include more than 900 chemicals since first published in 1987 and has been updated at least once a year. The law has catalog and internet labeling requirements that have been in effect since August 30, 2018.

WHY PROPOSITION 65 MATTERS TO THE CBD INDUSTRY

As of January 1, 2021, California is requiring a Prop 65 warning on products sold in the state containing any amount of Delta-9 THC. The label contains the words “WARNING Cancer and Reproductive Harm www.P65warnings.ca.gov”. Violations of Prop 65 may result in civil suits, which have resulted in costs up to $30,000 per violation and have included everyone from manufacturers, distributors, and the retail businesses that sold products to the end consumer. In effort to protect your business and ours from Prop 65 liability, we must adapt our business to meet the requirements of the law.

HOW DOES PROP 65 IMPACT MY BUSINESS?

By necessity, we must put strict limitations on the way we conduct business with California clientele. In the broadest terms, we are restricting the ability for HempLucid resellers to ship HempLucid products into California unless certain requirements are met.

It is required that any HempLucid products sold into California have the Proposition 65 warning label affixed to the packaging in a prominent way.

HempLucid will be shipping all orders placed to a California address with a Prop 65 sticker on each product to ensure compliance. If you have a customer requesting shipment of HempLucid products into California, it is required that the order is placed directly through the HempLucid wholesale portal. This can be accomplished by logging into your wholesale account, placing an individual order, and changing the shipping address to reflect your California customer’s address.

Alternatively, you can place an order for your California clients directly with your Account Executive. After the order is placed, HempLucid will do the work of applying a sticker and shipping the item(s) to California.
